Electric Choice and Competition

Electric Competition Bill

On December 3, 1996, Governor Tom Ridge signed into law the Electric Competition Bill, Act 138. This Act will allow customers/members to choose the Power Generation Company that supplies their electric energy. In other words, you will be able to buy kWh's from any company you wish, but the company that supplies your service, (wires, meter, poles, etc.), will remain the same.

Investor Owned Utility (IOU) Competition Timeline:

  • December 1997: IOU Pilot Programs began.
  • 1999: 33% of Pennsylvania customers have a choice.
  • 2000: The next 33% Pennsylvania customers (or a total of 66%) have a choice.
  • 2001: 100% of Pennsylvania customers have a choice.

Legislation Primary Points:

  • Distribution territories remain intact.
  • Transmission & Distribution utilities will still be regulated.
  • Co-ops continue to be locally owned, operated & regulated by their members.
  • ALL PA co-op consumers are allowed to choose a new electricity generator supplier (EGS) or keep their present one.
